Mr. President: We Already Have the SAVE Act

Just Enforce It.

Alarmed by nationwide voter fraud, President Trump addressed the nation in July. In declassifying documents showing penetration of US election systems, a spotlight was placed on national security infrastructure that is under attack.

Advisors to the President on the solution are making a mistake. Our nation was not founded on securing technology, but on securing the sovereignty of the citizens over the law. Instead of increasing the vast Election Administrative State, we must think like the founders and focus on our rights and nationhood.

The SAVE Act already exists! The second sentence of the US Constitution is this very law on steroids, a KNOW-YOUR-VOTER (KYV) requirement since 1789. Combined with Article I § 1, it forces our laws to serve the citizens:

  1. Congress makes the laws we must obey;
  2. The People choose Congress;
  3. The States qualify the People who choose, using the voter eligibility laws governing their own legislative elections.

Are states qualifying voters by their laws? The answer is NO. California, New York and others have chosen ineffective means. Voters claim qualification and administrators take their word for it.

Failure is proven by an audit of New York City and State’s 2025 mayoral & statewide election, which showed an abysmal 23% failure rate in voter qualification. These votes were attributed in official records to “individuals” who don’t appear to exist, registered using a fake Social Security number, or did not live anywhere in the city at any time during 2025

That evidence is being aggressively investigated by the US Attorney for the Northern District of New York, John Sarcone and the FBI. It validates a pilot study completed by RealAmerica.Vote of the 2024 election in California, which showed a 21% rate of failure in voter qualification. A KYV review of the Los Angeles 2026 mayoral primary is underway.

Now that we see our “first, grand right” is being trampled, do we have a remedy?

James Madison never thought state governments were more trustworthy than the federal government. He warned,

“May it not happen in fine that the minority of CITIZENS may become a majority of PERSONS, by the accession of alien residents, of a casual concourse of adventurers, or of those whom the Constitution of the State has not admitted to the rights of suffrage?”

This is why the US Supreme Court held that the “right to choose” is a “constitutional command without restriction or limitation…secured against the action of individuals, as well as of States,” under criminal law.

When a State fails to constitutionally restrict access to choosing Congress, it has committed a crime against the Union, and a crime against the liberty right of every American citizen to have Congress chosen only by legally qualified voters.

Post-Civil War this risk was addressed by a Congress that had lived the cost of a fractured Union. They wrote Section 2 of the Fourteenth Amendment to compel loyalty to the Union by threatening federal reapportionment against States that abridge the voting rights of qualified US citizens.

We have remedies to enforce our SAVE Act: make cheating more painful than compliance.

New York and California must face accountability. These States have chosen an ineffective means of qualifying voters, counted unqualified voters’ votes in numbers that substantially overcome margins of victory, thereby sent legally uncertain members to Congress, refused to allow the US Department of Justice to review the voter lists they maintain as Officers of Congress, and denied or delayed Article III standing to citizens seeking redress of their disenfranchisement in Election Integrity Project California, Inc. v. Weber et al., and NY Citizens Audit Civic Fund, Inc. et al. v. Letitia James & the NYS board of elections.

Mr. President, you already have the SAVE AMERICA Act. You have the power to enforce the guarantee of republican government defined by Alexander Hamilton as, “The representation of the people in the legislature by deputies of their own election.”  RealAmerica.Vote is standing by to rapidly measure voter qualification compliance anywhere at any scale.
